By purchasing a session you agree to the following terms.

* 1 session available per booking per family - this only applies to special deals, Christmas or discounted sessions only

* Session fee is NON REFUNDABLE. Can not be transferred. No discounts, coupons &/or vouchers can be used in conjunction

* Does not include outfits (maternity, newborn & sitter sessions include use of outfits)

* Photography is strictly prohibited during the session. Please ensure devices & cameras are not brought in to the session.

* Session duration varies from session to session. As a guide maternity session is approx 45min, Newborn is approx 2.5-3hrs, Sitter is approx 30mins & Sunset family session is approx 35mins.

* Sitter sessions are just for the child or children (if twins, triplet etc) only and from the ages 7-9 months when your child can sit interdependently but not yet crawling.

* Your spot is not secure unless payment of the session fee has been made

There is no purchases until you see the final photos & love your photos. The reveal & booking appointments will be made a couple of weeks after the sessions have finished. The photos as you can see are very different from others and take a couple of hours to edit per photo. 


SESSION AGREEMENT Please read all information carefully in the Session Agreement below and print a copy for your records. Once you've read the Session Agreement and the Terms and Conditions, please provide your digital signature below. 


MODEL RELEASE In order for me to be able to post your sneak peeks on the facebook & Instagram or images on the website, you'll need to sign this optional Model Release: "The photographs taken and presented by this photographer may be used by Little Freckles & Co. Photography and its agents, for the purpose of display, portfolio, advertising, website or publication to promote the business without compensation to the undersigned. You may request that specific images not be made public if they are of a personal nature by submitting in written notification to Little Freckles & Co. Photography." I do not identify child subjects by their full name on my websites or social media. Adult subjects may be identified online in the sharing on images on the blog, Facebook or Instagram. Please indicate below if you accept or decline the MODEL RELEASE for ALL session participants & please outline any exceptions to the model release if you would like to make any.

1. Payment Terms - Upon confirmation of the Client’s booking by the Photographer, a non refundable retainer/deposit payment of $100 is required to secure the agreed session time and date (the “Appointment Date”).

2. Ordering - Full payment is required for amounts relating to orders. Without payment, orders won’t be processed by the Photographer.

3. Retention of Copyright - All Images and the copyright within them shall remain the sole and exclusive property of the Photographer in perpetuity. No copyright of any images shall pass to the Client on the granting of reproduction rights.The right, by way of license to use the images is passed to the Client only upon full payment of all outstanding monies. This license is non-transferable and intended exclusively for personal use. No Image may be used for promotional, advertising or any other commercial purpose without the express permission of Photographer and, at the discretion of the Photographer, the payment of additional fees and an accompanying written credit to the Photographer. The Client will not make or permit any alterations to be made to the Images, including but not limited to, additions, subtractions, or adaptations in respect of the Images.


4. Postponement - In the case of an emergency event including, accidents and health crisis or similar situations. Little freckles & Co. Photography expressly reserve the right to reschedule any shoot taking place. If local council or the Australian Government have deemed our industry to close for reasons of covid-19 lockdown or alike, no refunds will be given, but your paid amount will be transferable to use on any future full priced photography session with Little Freckles & Co. Photography to be used within 6 months of being able to re open business. If you or your child is unwell on the day of the shoot, please contact the Photographer as soon as possible so that the session can be rescheduled. Failure to notify will result in a forfeit of the session fee.


5. Cancellation Policy - Once the Appointment Date has been confirmed by the Photographer, the Photographer will not accept any other work from other clients for the Appointment Date. As a result, once a booking is made, subsequent cancellation without mitigating circumstances (at the discretion of the Photographer) will result in the forfeit of 100% of the session fee. In addition to the cancellation fee, the Client will be charged for any expenses incurred by Photographer between the confirmation of the booking and the cancellation by the Client. You will be required to pay a full additional session fee to secure a new date


6. Liability - In the event of any loss of Images due to, but not limited to, damage or computer malfunction, Photographer liability is limited to the value of the session fee. Photographer will not be liable for any loss or damage including (without limitation), indirect or consequential damages suffered by the Client or by any third party arising from the session or any use or reproduction of any Image.

7. Photographing any specific moment is not guaranteed and the Photographer cannot be responsible for any missed moments. It is expected that in booking Little Freckles & Co. Photography you have an understanding of the Photographer’s style. 


8. All images shown to the Client are at the discretion of the Photographer. There is no guarantee that any specific image from the session will be presented in the final gallery. All images not shown as final proofs will be purged after the initial processing stage. The Client will not be given access to the unedited images from the photo session.

9. Images presented to the client have all been individually processed on a calibrated monitor. Any images ordered may be edited further to bring the image to its full potential prior to being printed. Please note that prints may appear slightly different to the image displayed on a Clients monitor due to variation in monitor calibration. Any images not printed though Little Freckles & Co. Photography labs may not print the same as the digital file. Little Freckles & Co. Photography is not held liable for any printed products that the client chooses to print themselves or else where.

10. Small scratches, bruises and other transient blemishes may be removed during processing, unless the Client specifically requests that they be left in. This does depend on the amount of work required, and is not guaranteed to be performed. Freckles, birthmarks, miss a lined clothing and other apparent permanent blemishes will be left as they are unless it is specifically requested that they are removed. An editing fee may apply for any additional editing as requested by the Client.

11. Please ensure that images/products are chosen carefully. Once images/products are ordered, all sales are final and no refunds will be given. Due to the nature of photographic products, all images/products cannot be returned.


12. In the event that the Photographer fails to comply with the terms of the agreement with the Client due to equipment failure, theft, accident, ill health or any other circumstances beyond the Photographer’s control, liability is limited to monies paid only. Where the situation entails loss of images, Little Freckles & Co. Photography will offer the client a choice between a re-shoot or a full refund of monies paid.

12. Website Terms & Conditions - Little Freckles & Co. Photography grants you permission to access and view the content appearing on this site. You agree not to download, copy, print, reproduce or in any other way manner use any images from the site without the expressed written permission of Little Freckles & Co. Photography.The information on this website is provided for general information only. Little Freckles & Co. Photography has provided this information for the benefit of users in good faith and with reasonable care. Errors and omissions in this information may occur including through negligence. Accordingly, Little Freckles & Co. Photography does not accept any liability for any loss or damage which may directly or indirectly result from any opinion, information, advice, representation or omission contained on this website.

13. No refunds will apply to any sessions. Due to the custom nature of photography, strictly no refunds on either your session deposit, or your order total will be issued. This includes any prepayment of any funds that occur before the booked session itself. If any promotions arise where we are offering a discounted rate, this shall not apply to current booked sessions, or sessions that have been prepaid. Offers may not be used in conjunction with other offers. Offers are not redeemable for cash or products.

14. Clients that attend their photography session in a disorderly state, or show disrespect to Samantha McDonough, her assistant, family member and her photography equipment will result in cancellation of the session immediately. No refund will be issued as per the cancellation terms.

These Terms & Conditions are subject to change without notice at the discretion of the Photographer.

Upon the terms herewith stated, I hereby grant Little Freckles & Co. Photography (Samantha, the Photographer), her heirs, legal representatives and assigns the absolute and irrevocable right and permission to copyright, use, and publish a photograph or photographs of me and/or my child/children in any form and in all media for illustration, promotion, art, editorial, advertising, trade, or any other purpose.
